These Terms and Conditions govern the preorder of handmade guitars from N. Perez Luthier . By placing a preorder, you agree to the following terms and conditions:
1.1. A preorder secures your place in our production schedule for a handmade guitar.
1.2. Each instrument is custom-made according to the specifications discussed and agreed upon with the Customer before production begins.
1.3. Estimated production and delivery times are provided individually by the maker and confirmed in writing. Delays may occur due to the artisanal nature of the work or unforeseen circumstances.
2.1. A non-refundable deposit of 50% of the total price is required to confirm the order.
2.2. The remaining 50% balance is due upon completion of the instrument and before delivery or collection.
2.3. Payments are to be made in Euro (EUR) by bank transfer (SEPA for EU customers, international SWIFT transfer for non-EU customers) or other
methods agreed upon.
2.4. Prices for EU customers include German VAT (Mehrwertsteuer) at the applicable rate. For international orders, VAT is not included; the Customer is responsible for any applicable local taxes,
import duties, and customs clearance fees in their country.
3.1. Shipping is carried out via insured and tracked carriers. Costs for shipping, insurance, and handling are charged separately and will be invoiced prior to dispatch.
3.2. Worldwide delivery is available. Any customs duties, import taxes, or other charges imposed by the destination country are the sole responsibility of the Customer.
3.3. Risk of damage or loss transfers to the Customer upon handover of the goods to the shipping company.
3.4. The maker ensures professional packaging suitable for fragile instruments but is not liable for damages caused by shipping carriers. Transport insurance is highly recommended and can be
arranged at the Customer's cost.
4.1. The 50% deposit is non-refundable, as it secures materials, production time, and custom design work.
4.2. Refund requests beyond the deposit will be considered on a case-by-case basis. Customers are encouraged to contact N. Perez Luthier
directly to discuss possible solutions. Partial refunds or rescheduling may be offered depending on the progress of the build and specific circumstances.
4.3. In the unlikely event that the maker is unable to fulfill the order, a full refund of all amounts paid will be issued.
5.1. All guitars are covered by a Lifetime Warranty for the original owner, covering defects in craftsmanship and materials under normal
use.
5.2. The warranty does not cover:
Wear and tear (frets, finish, strings, etc.)
Damage caused by misuse, accidents, improper storage, or unauthorized repairs
Environmental factors such as humidity, temperature changes, or lack of proper maintenance
5.3. Any warranty claim must be submitted in writing with supporting photos and descriptions. The maker will assess the claim and offer repair, replacement, or other appropriate
solutions.
5.4. Return shipping for warranty repairs is at the Customer's expense. The maker covers the return shipping back to the Customer after warranty service.
6.1. All specifications (model, woods, finish, hardware, etc.) must be confirmed by the Customer before production starts.
6.2. Minor changes may be considered after confirmation, but are subject to feasibility, possible additional costs, and adjusted delivery timelines.
6.3. The maker reserves the right to decline changes that would compromise the quality, aesthetics, or technical aspects of the instrument.
7.1. As guitars are made to individual specifications and clearly personalized, the statutory right of withdrawal for distance contracts under EU consumer law (Directive 2011/83/EU, § 312g Abs. 2 Nr. 1 BGB in Germany) does not apply.
8.1. These Terms are governed by the laws of the Federal Republic of Germany.
8.2. For business customers, the place of jurisdiction is Berlin, Germany. For private consumers within the EU, the statutory consumer
protection regulations apply.
8.3. International customers agree that any disputes will be settled under German law, without prejudice to their mandatory local consumer rights.
9.1. The maker’s liability is limited to the value of the purchased guitar.
9.2. We are not liable for indirect damages, consequential losses, or any damages resulting from the use or inability to use the instrument.
By placing a preorder, the Customer confirms that they have read, understood, and accepted these Terms and Conditions.
